Terms of Service

1. Eligibility & Age

You must be at least 13 years old to use Kcal. If you are between 13 and 17, you may use Kcal only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By using Kcal, you represent that you meet these requirements.

2. Your Account

You can use Kcal as an anonymous guest or by creating an account (Google or email sign-in). You are responsible for the activity under your account and for keeping your credentials secure. You can delete your account and data at any time — see our Account Deletion page.

3. The Service

Kcal is an AI-powered calorie and nutrition tracker that lets you log food by text, photo, or barcode and estimates calories and macronutrients. We may add, change, suspend, or remove features at any time to improve or maintain the App.

4. Health, Nutrition & AI Disclaimer

Kcal does not provide medical advice, diagnosis, treatment, or professional nutritional counseling. All calorie counts, macronutrient values, and food identifications are automated AI estimates and approximations — they may be incomplete or inaccurate and are a starting point you can review and edit.

• Kcal is not a substitute for professional medical or dietary advice.
• Always consult a qualified health professional before making health, diet, or fitness decisions — especially if you have a medical condition, are pregnant or nursing, or have a history of disordered eating.
• You rely on Kcal's estimates at your own risk.

5. Your Content & License

"Your Content" means the photos, text, and data you submit to Kcal. You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and analyze Your Content solely to operate, provide, and improve the App (including AI food analysis, as described in our Privacy Policy). You represent that you have the rights to the content you submit and that it does not violate any law or third-party right.

6. Subscriptions, Free Trial & Billing

Kcal offers an optional paid subscription ("Kcal Premium") that unlocks the premium features described on the in-app purchase screen. Core tracking features remain available without a subscription.

Plans & pricing

Kcal Premium is offered as monthly, quarterly (every 3 months), or annual (yearly) auto-renewing subscriptions. The exact price for each plan, including any applicable taxes, is shown on the purchase screen in your local currency (where available) before you confirm.

Free trial

The annual (yearly) plan may include a 3-day free trial for new subscribers. The monthly and quarterly plans do not include a free trial and are charged when you purchase. If you start a trial and do not cancel at least 24 hours before it ends, the trial automatically converts to a paid annual subscription and the then-current yearly price is charged to your Google Play account. If you cancel during the trial, you will not be charged. Trial eligibility is determined by Google Play and may not be available if you have used a trial before.

Billing & payment

All payments are processed by Google Play, not by us. By subscribing, you authorize Google Play to charge the applicable fee to your payment method. Your purchase is also subject to the Google Play Terms of Service.

Auto-renewal

Each subscription renews automatically for successive periods of the same length (monthly, quarterly, or yearly) at the then-current price, unless you cancel at least 24 hours before the end of the current period.

Cancellation

You can cancel anytime in Google Play → Menu → Subscriptions → Kcal. Cancellation stops future renewals; you keep Premium access until the end of the period you have already paid for. Uninstalling the App does not cancel your subscription.

Refunds

Payments are generally non-refundable except where required by law. Because Google Play handles billing, refund requests are subject to Google Play's refund policy and are processed by Google. You may also email us at blackcoffeetechnology@gmail.com and we will consider reasonable requests at our discretion.

Price changes

We may change subscription prices. Any change applies to future billing periods and will be communicated in advance; where required, Google Play will ask for your consent before a new price takes effect. If you do not accept the new price, you can cancel before it applies.

7. Acceptable Use

You agree not to:

• use Kcal for any unlawful purpose or in violation of these Terms;
• upload content that is illegal, harmful, offensive, or infringing, or images of other people without their consent;
• reverse engineer, decompile, scrape, or attempt to extract source code, except where permitted by law;
• interfere with, disrupt, or overload the App or our servers, or bypass security, integrity, or usage limits;
• resell, sublicense, or commercially exploit the App without our written permission.

8. Intellectual Property

Kcal — including its software, design, branding, logos, and content (excluding Your Content) — is owned by BlackCoffeeTechnology or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the App for your own non-commercial use. You may not copy, modify, distribute, sell, or create derivative works from any part of the App.

9. Third-Party Services

Kcal relies on third-party services — including Google (cloud storage & sync, analytics, crash reporting, AI processing, advertising, and Google Play Billing), Android Health Connect, and Open Food Facts. Your use of these is subject to their own terms and privacy policies, and we are not responsible for them. See our Privacy Policy for details on what data is shared.

10. Termination

You can stop using Kcal and delete your account at any time. We may suspend or terminate your access if you breach these Terms or misuse the App. Provisions that by their nature should survive termination (including disclaimers, limitation of liability, and intellectual property) will continue to apply. Note that deleting your account does not automatically cancel a Google Play subscription — cancel that separately in Google Play.

11. "As Is" — No Warranties

Kcal is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that nutrition estimates will be accurate.

12. Limitation of Liability

To the maximum extent permitted by law, BlackCoffeeTechnology will not be liable for any indirect, incidental, special, or consequential damages, or loss of data, arising from your use of Kcal. Our total liability for any claim relating to the App will not exceed the total amount you paid for Kcal Premium in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Changes to the Service & These Terms

We may update the App and these Terms from time to time. If we make material changes to these Terms, we will update the "Last updated" date above and, where appropriate, provide notice in the App. Your continued use of Kcal after changes take effect means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, and you agree to the jurisdiction of the courts located in India — except where the mandatory consumer-protection laws of your country of residence require otherwise.
